Heavy Vehicle National Law

Under chain of responsibility laws (CoR), all parties who have control or influence over the transport task are responsible for complying with and for breaches of these laws.

In 2018, the Heavy Vehicle National Law (HVNL) will be amended to make it clear any party in the supply chain has a “primary duty” to ensure safe practices, rather than being deemed liable for breaches detected.

CoR requirements and legal responsibilities will now also extend to heavy vehicle standards, and the liability of executive officers and employers will broaden to encompass the entire HVNL.

This approach is similar to that of workplace health and safety laws and will be a significant step towards improving safety in the transport industry.

CoRCHECKS has Chain of Responsibility Obligations Covered

In order to align CoR with national workplace health and safety law, the primary duty obligation will be assessed against the “so far as is reasonably practicable” test, rather than the “reasonable steps” standard.

The CoRCHECKS process is quickly implemented, inexpensive, simple to use and meets the “so far as is reasonably practicable” test under National Heavy Vehicle Law.

CoRCHECKS Certification

The CoRCHECKS Certification has been approved by a Transport Engineer and referenced against the Load Restraint Guide (LRG) which provides transport drivers, operators, and other participants in the transport chain of responsibility with basic safety principles which should be followed for the safe carriage of loads on road vehicles.

All CoRCHECKS Certificates are stored in the cloud for a minimum period of three years as per NHVL requirements.
